Terms of Service

Understand the rules and conditions for using our platform.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Nutrifity (also branded as "FitPro Hub," "we," "us," or "our"), a company based in Croatia, European Union. By accessing or using the Nutrifity platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the platform. Your continued use of Nutrifity constitutes ongoing acceptance of these Terms and any future amendments.

2. Definitions

  • "Platform" refers to the Nutrifity website, applications, and all related services.
  • "User" refers to any person who accesses or uses the Platform.
  • "Achiever" refers to a client seeking fitness, nutrition, or coaching services.
  • "Professional" refers to Trainers, Nutritionists, and Coaches offering services on the Platform.
  • "Services" refers to fitness training, nutrition counseling, coaching, and related services offered through the Platform.
  • "Content" refers to text, images, videos, reviews, and any other material posted on the Platform.

3. Account Registration

To use certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and update your information to keep it accurate and current.
  • Keep your login credentials confidential and not share them with third parties.
  • Accept responsibility for all activity that occurs under your account.
  • Notify us immediately of any unauthorized use of your account.

You must be at least 16 years of age to create an account. We reserve the right to refuse registration or terminate accounts at our discretion.

4. User Types & Responsibilities

4.1 Achievers

As an Achiever, you may:

  • Search for and book services with Professionals.
  • Leave honest reviews and ratings after completed sessions.
  • Communicate with Professionals through the platform messaging system.
  • Manage your bookings, payments, and personal profile.

4.2 Trainers

As a Trainer, you may offer fitness training services, manage your calendar, set your own pricing, and build your client base through the Platform.

4.3 Nutritionists

As a Nutritionist, you may offer nutrition counseling, create meal plans, and provide dietary guidance. You represent that you hold valid certifications or licenses where required by applicable law.

4.4 Coaches

As a Coach, you may offer coaching services including performance analysis, team management, and athlete development programs.

4.5 Professional Obligations

All Professionals agree to:

  • Provide accurate information about their qualifications, certifications, and experience.
  • Deliver services as described in their listings.
  • Respond to bookings and messages in a timely manner.
  • Comply with all applicable laws, regulations, and professional standards.
  • Maintain valid certifications and licenses where required.

5. Platform Usage Rules

Nutrifity is a marketplace platform that connects Achievers with Professionals. We facilitate the connection but are not a party to the agreements between users. You acknowledge that:

  • Nutrifity does not employ Professionals and is not responsible for the quality of services they provide.
  • Professionals are independent service providers responsible for their own services, taxes, and compliance.
  • Nutrifity does not provide medical, fitness, or nutritional advice. All services are provided by independent Professionals.
  • You use services obtained through the Platform at your own risk and should consult with qualified healthcare professionals as needed.

6. Bookings & Payments

  • Commission: Nutrifity charges a commission of 3-4% on each transaction. This fee is deducted from the Professional's earnings.
  • Payment processing: Payments are processed securely through third-party payment processors (Stripe, PayPal). By making a payment, you also agree to the processor's terms.
  • Payment holding: Payments are held for a period of 7-14 days after service completion before being released to Professionals, providing time for dispute resolution.
  • Refunds: Refund eligibility is governed by our Refund Policy.
  • Pricing: Professionals set their own prices. Nutrifity does not control or set pricing for services.
  • Taxes: Users are responsible for any applicable taxes on their earnings or purchases.

7. Intellectual Property

The Nutrifity platform, including its design, logo, software, text, graphics, and other content created by us, is protected by intellectual property laws and is owned by or licensed to Nutrifity. You may not:

  • Copy, modify, or distribute any part of the Platform without our written consent.
  • Use our trademarks, logos, or branding without prior authorization.
  • Reverse engineer, decompile, or disassemble any part of the Platform.
  • Scrape, crawl, or use automated tools to extract data from the Platform without permission.

8. Prohibited Conduct

You agree not to:

  • Provide false, misleading, or fraudulent information, including fake reviews or fabricated credentials.
  • Harass, threaten, intimidate, or abuse other users.
  • Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to circumvent the Platform's payment system to avoid commissions or fees.
  • Upload or share content that is defamatory, obscene, discriminatory, or infringes on the rights of others.
  • Impersonate another person, user, or entity.
  • Interfere with or disrupt the Platform's infrastructure, including introducing malware or launching denial-of-service attacks.
  • Create multiple accounts to circumvent restrictions or bans.
  • Solicit users to transact outside of the Platform to avoid fees.

9. User Content

You retain ownership of content you post on the Platform. By posting content, you grant Nutrifity a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating and promoting the Platform.

We may remove content that violates these Terms or is otherwise objectionable, at our sole discretion and without prior notice. You are solely responsible for the content you post and its accuracy.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Nutrifity is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • We do not guarantee that the Platform will be uninterrupted, error-free, or secure at all times.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
  • Our total liability for any claim related to the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.
  • We are not responsible for the actions, content, or services of Professionals or Achievers on the Platform.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless Nutrifity, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

12. Termination

By you: You may terminate your account at any time through your account settings or by contacting us. Termination does not affect obligations incurred prior to termination, including pending payments or active bookings.

By us: We may suspend or terminate your account at any time, with or without notice, for reasons including but not limited to:

  • Violation of these Terms or any applicable laws.
  • Fraudulent, abusive, or harmful behavior.
  • Extended inactivity (12 months or more).
  • At our sole discretion, for any reason.

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property, limitation of liability, and indemnification.

13. Dispute Resolution

We encourage users to resolve disputes amicably. If you have a dispute with another user, we recommend using the Platform's built-in dispute resolution tools first.

For disputes with Nutrifity, you agree to first contact us at legal@nutrifity.com to attempt to resolve the matter informally within 30 days before initiating formal proceedings.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Croatia and applicable European Union regulations. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Croatia, without prejudice to mandatory consumer protection provisions of your country of residence within the EU.

15. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last updated" date, and (for significant changes) sending you a notification via email or in-app message. Your continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.
